The terms and conditions set out here form the basis of the binding legal agreement between
dineoutemirates.com and you (as member).  They set out the rules which are applicable to your participation in bargainout. You should read these terms and conditions carefully as your participation constitutes your acceptance of these terms and conditions.

These are the terms and conditions governing your use of this website (www.dineoutemirates.com) and the general principles for the websites of our subsidiaries and international and local affiliates and constitute your binding obligations towards dineoutemirates.com. This Agreement is effective upon acceptance/joining bargainout; dineoutemirates.com reserves the right to cancel or amend the Rules without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside dineoutemirates.com’s reasonable control any time by posting the amended terms on www.dineoutemirates.com. All amended terms shall automatically become effective immediately after they are posted on www.dineoutemirates.com and any subsequent use of the www.dineoutemirates.com shall be governed by such amended terms.  You are advised to regularly check for any amendments or updates to the terms and conditions contained in this Agreement. If any clause of the Agreement shall be deemed invalid, void or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the Agreement.

You must read, agree with and accept all of the terms and conditions contained in this Agreement and
dineoutemirates.com terms and conditions, which include those terms and conditions expressly set out below and those incorporated by reference, before you may become a member of dineoutemirates.com. We strongly recommend that, as you read this Agreement, you also access and read the information contained in the other pages and websites referred to in this document, as they may contain further terms and conditions that apply to you as dineoutemirates.com member/user.

Members participating are responsible for verifying independently that any merchant that they are doing business with is legitimate and reputable. It is also their responsibility to analyze the details and conditions of any voucher listed here before participating.

dineoutemirates.com does not provide any warranty or guarantee for the voucher published and assumes no liability whatsoever for their use or interpretation. In no event shall dineoutemirates.com, Moviemedia or any of its employees be liable for any special, indirect or damages of any kind, including, without limitation, loss of money or damages resulting from the use of this discount coupon.

dineoutemirates.com shall not be responsible or held liable if the restaurant declines or will not accept the voucher if this situation ever arises.  Any voucher may be subject to the additional terms and conditions of the sponsor/restaurant.

The member is responsible for their own travel arrangements unless stated otherwise. dineoutemirates.com shall have no responsibility or liability in respect of any travel arrangements.

Note: Since we have no control over how emails get delivered there may be occasions when the bargainout email alerts that are sent to you about the status of your bid gets delayed. We advise you therefore to keep checking the Bargain list in the bargainout page for the latest update on your bid status.

Please note: Participation in bargains held on this site is only open to persons aged 18 years and over.

Definitions

Bargain Close - means the time when the Bargain closes/ended.

bargainout bargain price - means an entry by a particular member in a particular bargainout bargain prize.

Member/You - means the individual who participates in the bargainout by placing a bid.

Members Account - means the personal account of the member in which they can access information like earned points etc.

Actual voucher amount - means the actual value of the voucher.

Lowest bargain price starts – means the minimum price you can submit.

bargainout voucher number – means the security number of the voucher.

Points - means the earned points of each member that can be used in replacement of cash.

bargainout voucher/voucher - means the item that members are placing bids for.

bargainout winner - means the member that is determined to have the right to receive a particular product/service on dineoutemirates bargainout as per this agreement.

Lowest Unique Price - means a price that is not the same as any other price on the same voucher

We/Our/Us - means dineoutemirates.com.

Concept

dineoutemirates bargainout is a feature of dineoutemirates.com which offers restaurant vouchers for members to buy. bargainout will be using the reverse bargain process in which the winner is the person who has the "Lowest Unique Price".
Lowest Bargain price is at AED 1 and the maximum price to submit is listed individually for each voucher.

Eligibility of membership

Use of dineoutemirates bargainout is available only to persons who can form legally binding contracts under applicable law. Persons who are "incompetent to contract" including minors, are not eligible to use
dineoutemirates.com bargainout. If you are a minor i.e. under the age of 18 years, you can register as a member of the site but cannot join bargainout. The participation of which to/by minors is strictly prohibited.
dineoutemirates.com reserves the right to terminate your membership if dineoutemirates.com discovers that you have participated and are under the age of 18 years.

Profile account and membership

Members are responsible for maintaining the confidentiality of their accounts and password and for restricting access to their computers, and all members agree to accept responsibility for all activities that occur under their account or password.

bargainout process

Members who are participating must not disclose, in any circumstance, details of their submitted prices. In addition, members must not enter any agreement with each other in order to increase the chance of winning.

All members who want to participate in this must be at least 18 years of age. Submitted prices may only be placed if the member has successfully completed our membership registration. dineoutemirates.com uses one or more third-party payment services for the acceptance of payments. While dineoutemirates.com has endeavored to ensure that due care is exercised in handling credit/debit card information, for the transmission of sensitive information over the Internet, dineoutemirates.com will not be held liable for any compromise or misuse of this information.

dineoutemirates.com reserves the right to cancel any submitted price under one or more of the following circumstances:   
a) The member provides any false, misleading or invalid information of any kind when registering or purchasing items.
b) A fraudulent method of payment is used.
c) The bank or other credit institution reverses the credit card transaction for the payment. 
d) A member co-operates with any other member when submitting the price.   
e) Any other breach of these terms and conditions.

dineoutemirates shall not be liable for any causes preventing the receipt of submitted prices for any reason, including, but not limited to an overload of the website server, downtime of a mobile phone network or any hardware or software failure.

Communications

When you visit dineoutemirates.com or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. dineoutemirates.com requires your consent during the registration process to occasionally send you promotional emails and updates regarding your submitted prices. These emails announce new changes and features added to the site to enhance your bargain experience as well as any special promotional auctions that maybe hosted by dineoutemirates.com

Fees and services

Regular membership on the Site is free. dineoutemirates.com does not charge any fee for browsing and checking available items and vouchers. All regular members can upgrade to the Gold membership where they can access and join all bargainout vouchers. However, dineoutemirates.com reserves the right to change its Gold membership fee and Credit policies from time to time. In particular, dineoutemirates.com may at its sole discretion introduce new services and modify some or all of the existing services offered on the Site.

In such an event dineoutemirates.com reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee Charging and Credit policies shall be posted on the Site and such changes shall automatically become effective immediately after they are posted on the Site. You are responsible for paying all payment associated with the use of the Site and you agree to bear any and all applicable taxes, charges, etc. levied thereon. dineoutemirates.com reserves the right to issue a warning, temporarily /indefinitely suspend or terminate your membership and refuse to provide you with access to the Site in case of non-payment by you to dineoutemirates.com . dineoutemirates.com also reserves the right to take legal action in case of non-payment.

bargainout winner

The member that places the Lowest Unique Price is determined the bargainout winner for that particular bargainout voucher.

In the event there is no single Lowest Unique Price, then the winner will be taken from two identical lowest prices submitted by two members and the person to submit first will win. If there is still no winner then the process will continue with three identical submitted prices then four etc. dineoutemirates.com will record the date and time of each submission down to the second and disputes over the time the submission was made will be unacceptable.

bargainout vouchers that close when the time has elapsed calculates the bargainout winner instantly, and members can access the winning details from their account. However, dineoutemirates.com reserves the right to cancel submitted prices at any time which, in turn, may affect the winner’s outcome.
Winners will be notified via email or contact numbers.

Delivery of products/services

Winner will have to pick up the vouchers from MovieMedia, Deira Dubai.

Or dineoutemirates.com can arrange a courier service to deliver the bargainout vouchers to any address within United Arab Emirates. dineoutemirates.com will charge the customer a fee depending on the courier charges to cover the delivery charges. Delivery of any item/product may take up to 28 days, however,
dineoutemirates.com makes every effort to deliver within 7-10 days.

It should be understood that dineoutemirates.com is not the direct supplier of the items or vouchers, and that the products may be supplied directly from the suppliers/producers/service providers etc, subject to the conditions of this agreement.

Guarantees are set by the supplier/producer/service provider and dineoutemirates is not liable and does not provide additional guarantee.

Severability

If any provision of these terms and conditions is held to be invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

Publicity

dineoutemirates.com may release any information concerning the status of a bargainout bargain during the course of a bargain.

Members and participants/winners acknowledge and agree that they may be used in publicity, marketing or promotional activities without further consent or payment. Such publicity, marketing or promotional activities may include without limitation the winners name and/or likeness, voice, video footage and/or photographs of the winner and their companions, winners agree that any or all such elements may be used by
dineoutemirates.com and its affiliated companies without charge in any and all media in perpetuity throughout the world as the dineoutemirates.com in its sole discretion sees fit.

Each member or participants must also acknowledge that dineoutemirates.com is permitted to publicise every offer value of every bargainout bargain winning price when the bargain has been completed. Winners will be notified via email or contact numbers. All prizes must be collected within 30 days after the winners are notified.  

Indemnity

You will indemnify and hold dineoutemirates.com/MovieMedia (and our officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.

Resolution of disputes

If a dispute arises between a member and dineoutemirates.com, our goal is to provide our members with a neutral and cost effective means of resolving the dispute quickly. Accordingly, members and
dineoutemirates.com agree that we will resolve any claim or controversy at law or equity that arises out of this Agreement. We strongly encourage you to first contact us directly to seek a resolution by going to the contact us page. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

We accept no liability in connection with the inclusion of any restaurant from this page, and will not be responsible for any changes that may arise in the future.
